Perawan Hilang di Sumur Tua

HARI itu Kamis tanggal 24 Maret 2009. Suasana Aldeia Tidibesi, Suku Lisafat, Sub Distrik Ermera, Distrik Ermera biasa-biasa saja. Warga setempat melakukan aktivitas sehariannya seperti biasa. AS, salah seorang gadis kampung itu hatinya berbunga-bunga karena hari itu kekasihnya berinisial FH yang tinggal di Dili akan bertamu di rumahnya.
AS mempersiapkan segala sesuatu untuk menyambut kekasihnya. Salah satu aktivitasnya adalah mandi di sumur tua yang letaknya 3 meter dari jalan raya. Ia tidak pernah membayangkan akan terjadi sesuatu pada dirinya. Yang terlintas dalam benaknya hanya rasa gembira karena hari itu ia dikunjungi kekasihnya.
Sementara sang kekasih yang sekarang harus menelan pil pahit dibalik trali besi, bak seorang satria dan bermodalkan sebuah sepeda motor bebek merk Honda berwarna hitam bergegas menuju tempat sang kekasih. Perjalanan Dili-Ermera hanya ditempu dalam waktu satu jam.
Saat tiba di Ermera, FH menemui AS sedang mandi di sumur tua. Matanya membelalak melihat sang kekasih mandi dan melulur tubuhnya dengan sabun. Rasa lapar dan dahaga pun hilang seketika. Pikirannya berubah. FH ibarat Harimau yang ganas dan siap menerkam mangsanya.
Setelah parkir sepeda motornya di pinggir jalan raya, FH menghampiri sang pacar yang sedang mandi di sumur tua. AS tidak mencurigai kalau FH berpikir jahat terhadap dirinya. Ternyata, kedatangan FH justeru membawa malapetaka bagi dirinya. AS diancam akan digorok lehernya dengan gergaji jika tidak menyerahkan mahkotanya.
Jaksa Penuntut Umum (JPU) Jose Landim melalui sidang di Pengadilan Distrik Dili menyebutkan bahwa saat itu FH meletakkan gergaji di leher AS hendak menggoroknya jika ia tidak melayani nafsu birahinya. “Jangan bergerak dan berteriak. Kalau berteriak, lehermu putus hari ini,” kata FH seperti ditirukan JPU Jose Landim.
Menurut Jose, saat itu AS berusaha untuk melepaskan diri dari ancaman itu. Namun, tenaganya tidak sekuat sang kekasih. Akhirnya, ia pasrah dan membiarkan sang kekasih merenggut kegadisannya yang selama bertahun-tahun dijaga agar tidak ternoda. Setelah pakaian AS dilucuti, FH melepaskan rudalnya tanpa memikirkan dampak dari kenikmatan sesaat itu.
Ketika kedua anak manusia itu sedang bergumul di samping sumur tua, tiba-tiba muncul Mariano do Santos (Bapak kecil AS). Dia baru pulang dari rumah sakit. Ia mencurigai ketika melihat sebuah sepeda motor pakir di dekat sumur tua itu. Lalu, ia secara perlahan-lahan melangkah menuju sumur tua sambil melihat kiri kanan. Ia bertanya dalam hati siapa pemilik sepeda motor ini dan berada dimana? Saat mendekati sumur tua itu, ia terkejut melihat dua anak manusia sedang berhubungan seksual layaknya suami-istri.
Dalam kesaksiannya di Pengadilan Distrik Dili, Mariano menyebutkan bahwa ia melihat dengan mata kepala sendiri kedua insan melakukan hubungan seksual di samping sumur tua dengan posisi dog style. Ia langsung tangkap lelaki itu dan menampar pipi AS. Lalu, kedua anak manusia itu dibawa ke rumah agar kasusnya diselesaikan secara kekeluargaan. Namun, tak lama kemudian, FH melarikan diri dan menjadi buronan polisi. Atas kerja sama polisi dengan masyarakat, tersangka tertangkap polisi beberapa bulan kemudian. Peristiwa itu benar-benar menggegerkan warga setempat.
Dalam persidangan, AS (korban) menuturkan bahwa ketika ia sedang mandi, tiba-tiba muncul seseorang laki-laki dari belakang dan langsung meletakkan gergaji di lehernya sambil mengatakan “Jangan bergerak dan berteriak, kalau tidak lehermu putus hari ini”. Ia berusaha untuk menyelamatkan diri, namun tidak berhasil.
“Saat itu saya hanya mengenakan pakaian dalam alias CD dan BH. Tiba-tiba ada seseorang dari belakang saya dan menaruh gergaji di leher saya. Kalau saya berteriak leher saya putus. Akhirnya, saya pasrah,” kata AS. (oki)

Journalist faces criminal defamation threat in East Timor


Bangkok, February 29, 2016 - The Committee to Protect Journalists calls on East Timor's prime minister, Rui Maria de Araujo, to drop the criminal defamation complaint he is pursuing against freelance journalist Raimundos Oki. Oki faces up to three years in prison if convicted of defamation for a report for the Timor Postnewspaper alleging possible irregularities in a government computerization project, according to press reports.
The legal complaint stems from an article Oki published on November 10, 2015, about possible bid-rigging in a project Araujo's government awarded to a private company to supply and install computers at the Ministry of Finance, according to press reports. Oki's article, citing internal government documents, alleged that Araujo had, while working as an advisor to the minister of finance in 2014, recommended that the same company win the multi-million dollar contract.
Oki told CPJ that he first received written notice of the criminal complaint on January 22, and that public prosecutors summoned him for questioning twice since, but later cancelled the scheduled meetings for unknown reasons. The prosecutor's investigations, which Oki said were still in progress as of February 26, would determine whether the state would file formal charges, Oki said.
Oki said anonymous callers have called his mobile several times since he received written notice of the investigation against him, accusing him of trying to destroy the ruling Fretilin Party, and telling him he needs to be "careful." In response to those threats, Oki says that he now travels only with a group of colleagues when returning home from work at night.
"We call on Prime Minister Araujo to drop his criminal defamation complaint against journalist Raimundos Oki and to instruct police to investigate the anonymous threats Oki has received," said Shawn Crispin, CPJ's senior Southeast Asia representative. "Criminal defamation laws have a toxic effect on press freedom in all countries that have them on their books. Araujo should work to abolish East Timor's defamation laws, not use them."
Oki told CPJ that Araujo declined the opportunity to comment for his original story, an opportunity East Timor's Press Law requires journalists give to subjects of critical news articles. One week after Oki's original report ran, the Timor Postpublished, on its front page, Araujo's reply, in which he denied any irregularities in the project's bidding procedures. The following day, the paper published a correction to the spelling of the name of the private company that won the contract, but not to the spirit or content of the original story, according to Oki.
East Timorese officials have used criminal defamation laws to suppress media criticism of their actions in the past. Oki faced a similar criminal defamation suit in 2013 over his reporting, then for the local Jornal Independente newspaper, on a state prosecutor's controversial handling of an automobile homicide case. A District Court judge ruled that Oki's reporting was not defamatory, but nonetheless made him pay a $150 fine for causing the official "psychological disturbance."

Timor Leste prime minister files defamation suit against journalist

Timor Leste Prime Minister Rui Maria de Araujo filed a defamation lawsuit against a journalist in connection with an article alleging irregularities in a government computerization project.
Araujo filed the defamation suit against Raimundo Oki of the Timor Post. Oki wrote in an article published on 10 November 2015 that the Prime Minister, in a previous capacity as Advisor to the Minister of Finance, recommended the winning bid for a project to supply and install computer equipment to the new Ministry of Finance building in 2014.
The Timor Post published the Prime Minister's reply to the article in the paper's front page on 17 November 2015. The right of reply is guaranteed under Article 34 of the country's new Press Law, Number 5 of 2014. Timor Post published a clarification of Oki's report in its 18 November 2015 issue.
Despite these efforts of the publication, the defamation suit was still filed against Oki, who received a notice of the case on 22 January 2016.
Defamation for false accusations is a crime punishable for up to three years under Article 285 (1) of the Timor Leste Penal Code.
"The Prime Minister should lead by example on how to respect the country's Press Law by recognizing that such reporting is part of the work of journalists," said Felipe Belo, president of the Timor Leste Journalist Association.
Article 8 of the Timor Leste Press Law clearly protects the work of journalists, and states "The right of journalists to report shall be exercised on the basis of constitutional powers, may not be subjected to interference that threatens their independence and objectivity, freedom of establishment, and freedom of conscience."
"If Oki made a error in reporting, it should be dealt with under the Press Law," said Belo.
"The lawsuit is an act of criminalization of the work of journalists," added Belo. The defamation case effectively ignores the application of the Press Law, as the specialized law that should address such cases, he explained.
Under the Press Law, such cases fall under the authority of the Press Council.
In 2013, Oki faced a defamation charge on another corruption case but was absolved by the court.
Timor Leste ranked 103rd out of 180 countries in the 2015 World Press Freedom Index of the Reporters Without Borders.

UN leaves, but E. Timor still facing rampant poverty

Dili, Dec 28, 2012 (AFP) - The UN winds up its peacekeeping mission Monday after 13 years in Asia's youngest nation East Timor, with the country hoping to overcome its bloody past and rampant poverty to stand on its own feet.

East Timor this year conducted largely peaceful elections, voting in a new president and parliament, as the country marked a decade of formal independence and paved the way for the foreign forces to leave. But as the last remaining UN police and troops trickle home, the fragile democracy is still struggling with widespread malnutrition, high unemployment and maternal mortality rates that are among the worst in the world.

East Timor was occupied by Indonesia for 24 years, with some 183,000 people dying from fighting, disease and starvation before the half-island state voted for independence in 1999 in a bloody referendum, prompting the first UN mission. There is little concern about renewed violence in the immediate future, yet few employment opportunities, crushing poverty and a rapidly expanding population could still threaten peace in the long term, analysts say.

"There's always in this situation the potential for something serious to go wrong," George Quinn from the Australian National University told AFP.
More than 40 percent of young Timorese are jobless, according to AusAID, and although the predominantly Catholic nation has a small population, the fertility rate of 6.5 per woman is the world's fourth-highest, UN data shows.

Despite $1.5 billion of aid pouring into the nation of 1.1 million people over the last decade and abundant offshore oil and gas reserves, some 41 percent of the population live on less than the local poverty line of 88 cents a day.

In and around the capital Dili, barefoot children can be seen eating scraps from the ground in slums, and the pace of life remains slow, with vendors making a pittance at fruit and vegetable markets.

World Bank data from 2010 showed 45.3 percent of children under five were malnourished, up from 40.6 percent in 2002, while on the UN's human development index, East Timor ranks 147th out of 187 nations, below Pakistan and Bangladesh, and well below the regional average.
East Timor's economy has also become visibly two-tier since 1999 -- there are those raking in US dollars from government infrastructure projects in urban areas, while the majority are subsistence farmers in far-flung villages.

Prime Minister Xanana Gusmao insisted after his July re-election that energy revenue would transform East Timor "from being an undeveloped, low-income country by 2030, by making use of all our material and human potential".

While the country's Petroleum Fund has swollen to $10.5 billion and makes up between 80 to 90 percent of government revenue, critics point out the reserves are fast falling as they call for diversification of the economy.

Rural Timorese also complain the money has not changed their lives, saying the funds are channelled to the city through infrastructure projects.
"East Timor has always had a problem with properly disbursing its income, and that problem still persists," Quinn said.

Despite the problems still facing East Timor, the departure of the remaining UN forces -- which numbered 1,600 at the mission's peak -- nevertheless underscores the progress the country has made in recent years.

The withdrawal has been welcomed by most, especially leaders who insisted on the country's ability to handle its own security well before responsibility was handed back to national police in October.

Foreign troops ended their peacekeeping mission in the half-island nation of 1.1 million people on December 31 and Asia's youngest country is now turning its focus from security to building an economy almost entirely from scratch.

A 20-year plan spearheaded by Prime Minister Xanana Gusmao aims to transform the nation of predominantly poor subsistence farmers to an upper-middle-income economy that exports cash crops, livestock and processed oil products.

The task is mammoth for what the IMF has dubbed the "most oil-dependent economy in the world", which produces little beyond some $15 million in coffee a year, mostly for Starbucks, accounting for 90 percent of its non-oil exports.

World Bank country manager Luis Constantino said East Timor was, in fact, a "big example of things actually going right".

"They rightly focused on stability, they achieved peace, they created confidence in the state, they devised a vision and they put institutions in place to guide the country forward," Constantino told AFP.

However, the country's double-digit growth in recent years has come almost entirely from controversial state spending of the nation's $11 billion petroleum fund.

The money has steamrolled much-needed infrastructure, most of which was destroyed in Indonesia's 24-year occupation, when some 183,000 people -- then a quarter of the population -- died from starvation, fighting and disease.

"Now there's the challenge to diversify Timor-Leste's economy to one that's not just dependent on oil but creates other sources of wealth," Constantino said, referring to the country by its official name.

After criticism, the government plans to draw only 66 percent of its budget, or $1.2 billion, from the petroleum fund this year, down from 80 percent in 2012.

But the opposition Fretilin Party said the government had neglected 75 percent of the population who are subsistence farmers.
"If you look at the amount of money the previous government spent, over $4 billion, you wonder where it all went," Fretilin member of parliament Estanislau da Silva said.

Only 20 minutes from the centre of the capital Dili, what the economic challenges mean for ordinary people is only too apparent.
Malnourished children with bloated stomachs and runny noses play among ramshackle tin huts in the village of Kulau Rai Hun, as jobless parents sit idly by a dirt road, drinking coffee and smoking.

Marta de Jesus, 48, and her husband, a taxi driver who earns $5 on a good day, cannot grow or buy enough food to meet their nutritional needs.
"We get through around 50 kilograms (110 pounds) of rice every week. That's all we eat. If we have more money we can buy meat and sometimes corn," she said outside her two-room dirt-floor home.

The couple had 13 children, two of whom died from malaria and malnutrition.
The country's fertility rate -- the fourth highest in the world, with an average of 6.5 children per family -- will only exacerbate food insecurity and unemployment, which is more than 40 percent among youths, according to AusAID.

To tackle both issues, the government plan includes the cultivation of cash crops such as palm oil, vanilla and candlenut for export. The country now imports almost all fruit and vegetables.

But experts are skeptical.
"It's never going to develop a viable secondary industry sector, it simply doesn't have a sufficient market domestically, nor does it have the requisite skills," Damien Kingsbury from Deakin University in Melbourne said.

Downstream energy industries are touted as the nation's best hope, but Kingsbury called an estimated $10 billion development of the southern coast as an oil and gas supply base and refinery "questionable at best".

Charles Scheiner from the Timor-Leste Institute for Development Monitoring and Analysis said the plan was "a very attractive dream for the kind of lives the people deserve".

It should focus, however, on realistic goals, such as improving health and education, which received only some 10 percent of the budget, he said.
"Timorese don't need propane, or diesel fuel. They need food and water, and 80 percent are farmers, so that's where the focus of economic development should be," Scheiner said, adding only two percent of the budget goes to agriculture.

Deputy Prime Minister Fernando La Sama de Araujo said the government recognized the scale of the challenge but was still hopeful it could improve people's lives.

Displaced Residents Demand Help, Five Months After Eviction

The people who were recently forced by the government tho leave their houses in the area of the former Indonesian Police Brigade College in Perumnas, Dili, went to the President's office to demand assistance previously promised by the Justice Ministry.


In their demonstration in front of the President's office, members of the 159 households, who are now staying in temporary accommodation in Ai Lok Laran, asked President of the Republic Jose Ramos Horta to help resolve the problem.

Coordinator of the displaced households Ricardo Soares said when his group was forced to leave its originla place, the Justice Ministry promised to provide assistance. But, he said, after five months there had not been any result.

“We are demanding because the Justice Ministry promised that (within) only three days (it would resolve the problem) but (it has) already (been) five months,” Mr Soares said during the demonstration.

He said his group faced many problems, including sickness, a lack of health care and children having left school.
The place where they were staying was inappropriate, he said.

Representative of NGO Forum Tau Matan, Onorio Soares Almeida, who was involved in the demonstration, said he wanted the government to resolve the problem. “They (the community) are really suffering. The pregnant women did not get good health attendance (and) many children lost their school activities”, Mr Soares said.

Meanwhile President Ramos Horta said he wanted a solution to the problem to be found soon. “The State's land is needed to our police but (we) must also find solutions for the poor people if needed,” Ramos Horta said.
He said he would ask Prime-Minister Xanana Gusmao if he could intervene to resolve the problem.

PNTL Officer 'Tortures' Jose Tolan With Pistol

A member of the National Police of Timor-Leste (PNTL) allegedly tortured a man in Tasitolu, Dili, on Friday night.

After allegedly beating the victim, Jose Tolan, the suspect code-named EFS, reportedly pulled out his pistol and tried to shoot Mr Tolan, but his pistol failed. He then used the gun to threaten the victim's family, witnesses said.

Then EFS, who dressed in civilian clothing, allegedly took the victim to his house in Hudilaran to continue torturing him. A witness and neighbor of the victim, Markus Ulan, said when he saw Mr Tolan taken away he contacted the Comoro Police Station and asked them to go to the suspects house. He said Comoro Police Officers found Mr Tolan and took him to the Bairro Pite Clinic.

After receiving treatment at Bairro Pite Clinic, the victim was taken to the National Hospital Guido Valadares for further treatment. He remained in Hospital late last night, where he was in a lot of pain. "I feel some of my bones have broken. I am finding it very hard to breathe," Mr Tolan said in Hospital.

"He (the suspect) bashed me on my head with a pistol until it broke and all the bullets came out. He punched and hit me, and almost shoot me," he said.
